Separation of Powers Law

This site is intended as a resource for students and teachers of separation of powers law, especially for those using Peter M. Shane, Harold H. Bruff, and Neil J. Kinkopf, Separation of Powers Law:  Cases and Materials (4th ed. 2018), published by Carolina Academic Press.  Peter is the Jacob E. Davis and Jacob E. Davis II Chair in Law at The Ohio State University’s Moritz College of Law.  Hal is the Rosenbaum Professor of Law Emeritus and Dean Emeritus at the University of Colorado Law School.  Neil is Professor of Law at the Georgia State University College of Law.

We are also making available for downloading without charge our materials on impeachment: Shane Bruff and Kinkopf Impeachment Materials. These pages are licensed for noncommercial reproduction for teaching and research.

The text is designed for flexibility.  It can be used in courses focused on separation of powers issues across the whole government, courses focused on the presidency, courses focused on domestic issues, and courses focused on military and foreign affairs issues. As the authors use the text, we will make our own syllabi available as models. We will also be providing supplementary materials, sometimes reflecting current events, sometimes reflecting older materials we have simply found helpful in taking a deeper dive into various issues.  Professor Shane has posted slides he developed for class based on our 2011 Third Edition and will eventually post slides for the Fourth Edition, as well.  Adopters of the book can get access to the password-protected slides on request to Professor Shane.
